TCI Testifies at P3 Hearing
APC Executive Vice President Bob Latham today discussed transportation funding and Public Private Partnerships with the House Republican Policy Committee. He indicated support for P3 projects that enhance highway and transportation capacity. Latham also noted that Act 44 will take some immediate pressure off our transit and highway funding needs and should not be repealed. However, he warned that Act 44 is not a long-term solution and should only be viewed as a short-term or stopgap solution to our transportation funding problems. EEO-DBE Committee Meets
The APC EEO-DBE Committee met yesterday with PennDOT Bureau of Equal Opportunity officials. Craig Hoogstraten of Buckley & Company is APC’s EEO Chairman. APC is strongly urging that the Department rescind its recent requirement of monthly by project workforce reports (EO-400). This report is very time consuming and burdensome. PennDOT requested that APC develop a proposal for them to review. Other subjects covered included training requirements and commercially useful function of DBE’s. |

Risk Allocation Committee Meets
Co-chairmen Geoff Clarke of New Enterprise Stone and Lime Co., Inc. and PennDOT Construction Bureau Director Dave Azzato led Risk Allocation discussions on Tuesday. Items covered included renewed efforts to update the Department’s fuel adjustment clause. It was noted that the current formula is based on high sulfur No. 2 diesel and that ultra-low sulfur is mandated. Discussions were also held on design-build, railroad indemnity, work order payments, and incident response requirements. |

PTC Message Regarding October 10, 2007 Bid Opening Error
The PA Turnpike Commission (PTC) posted the following notice regarding the error in the bid opening for October 10, 2007. The problem was due to PTC user error. Briefly, here is what happened:
- The project was created, the schedule of items was uploaded, the Expedite file was created, and the project was saved to pending status.
- PTC personnel deleted the project but (this is the key) did not delete all associated documents thereby leaving the Expedite file on the server with an associated project ID.
- PTC personnel re-created the project, uploaded a new schedule of items that generated a new project ID within the system but did not overwrite the existing Expedite file on the server and advertised the job.
- Due to the design of Expedite, when the new schedule of items was uploaded a system-generated “addendum” file was created. But, it was not truly an addendum file.
- When our business partners downloaded the EBS file from the system it did not include the system-generated “addendum” files.
- When EBS opened the bids and checked the project ID’s of these bid files, it determined they did not match the project ID of the original (but deleted) project.
The PTC has since revised its procedures to ensure that this does not happen in the future.

District 3-0 Fall Meeting Location Set
The location for the APC/PennDOT Fall Meeting in District 3-0 has been set. The meeting will take place from 1 to 3 p.m. on October 23, 2007, at the Pennsdale Civic Center. Go here for more information on this and other scheduled meetings. |

Baker Names Brad Mallory Chief Operating Officer
The Board of Directors of Michael Baker Corporation has appointed Bradley L. Mallory chief operating officer of the company, effective October 15. In this position, he will have responsibility for the day-to-day management of the company's engineering operations, as well as the development and execution of the business' strategic plan.
Presently, Mallory is president of the engineering business segment, having assumed that position in October 2003. He joined Baker in March 2003 as a senior vice president, following more than 20 years of experience in transportation and related fields with the Pennsylvania Department of Transportation, including serving as the Department Secretary from 1995 until his retirement in early 2003. During his tenure, he increased customer satisfaction levels, delivered record levels of major construction projects on time and on budget for five consecutive years, and led efforts nationally to streamline the project delivery process.
