PennDOT has issued a revised email on ECMS notifying contractors regarding required submissions of DBE participation information. Earlier this week, contractors received notice that all bidders are now required to submit DBE participation and, or evidence of Good Faith Effort.
APC raised several issues including the concern that ECMS is only set up to allow the apparent low bidder to submit this information. PennDOT has advised that the Expedite replacement now allows all bidders to submit. APC also raised concerns that this is potentially burdensome and that the threat of a “Strike” against all bidders is excessive. We have preliminary indication from PennDOT that is not the intent. Below is the latest communication from the Department. APC continues to work with the Department on clarifying this directive.

Subject: ***UPDATED*** IMPORTANT DISADVANTAGED BUSINESS ENTERPRISE (DBE) PARTICIPATION REMINDER REGARDING 04/25/19 LETTING
***PLEASE DISREGARD THIS EMAIL IF PENNDOT HAS ALREADY CONFIRMED RECEIPT OF REQUIRED SUBMISSION***
PennDOT received at least one bid from your company for a Federal-aid project from the 04/25/19 letting. In accordance with Pub. 408, Designated Special Provision 7 (DSP7), your company is directed to complete the following for each bid that was submitted by your company for Federal-aid projects by 3:00 P.M. prevailing local time on 04/30/19:
- Complete ECMS Project Minority Participation and Commitment Screen, including NAICS codes for all DBEs
- After DBE acknowledgement, submit ECMS Project Minority Participation and Commitment to PennDOT
- If DBE project goal was not met, submit ECMS Good Faith Effort Evaluation Request to PennDOT
The initial, apparent low bidder that fails to comply with DSP7 will have its bid rejected. Any other bidder that fails to comply with DSP7 will be ineligible for award.
When the date that this submission is due falls on a day that the PennDOT Central Office is closed, complete the above by 3:00 P.M. prevailing local time on the next business day.
