One major fear that every contractor faces are the alleged “defects” in work which become apparent well after the work has been done, and in some cases, after the road has been opened to traffic for years.
Does the Owner have the right to demand remedial work? Can the Owner hold payment if the job is still open, or threaten default and demand that the bonding company step in and make sure the work gets done? What are the contractor’s rights when “latent” defects arise?
