To ensure compliance with the Federal Buy America and BABA Phase Two requirements, PennDOT has developed a plan which will require that all Bulletin 15 items comply with the cost of components of manufactured products that are mined, produced, or manufactured in the U.S. must be greater than 55% of the total cost of all components of the manufactured product in addition to the final assembly requirements. The Department will begin including a special provision (attached) with changes to Publication 408, Section 106 to reflect these new requirements. This will go into all projects advertised on or after October 1, 2026.
